At Cascade Digital Marketing, we provide strategic marketing services for professional services firms through customized service agreements. We believe in strategic marketing that serves your business goals, not agency profits. Our research-first, AI-enhanced approach includes Marketing Strategy & Research, Web Design & SEO, Digital Advertising, Content Marketing, Email Marketing, Social Media Management, and Branding services. This Account Usage Policy outlines the rules and responsibilities for using our services. By engaging with Cascade Digital Marketing, you agree to comply with this policy.
1. Service Access and Usage
- Non-Transferable Services: Services provided under your agreement are exclusive to your business. These services cannot be transferred, shared, or resold to others without our written consent.
- Service Scope: Cascade Digital Marketing delivers strategic, research-backed marketing solutions tailored to your business goals. Services vary by agreement and may include strategy development, website design and optimization, digital advertising campaigns, content creation, email marketing, social media management, and branding.
- Communication Channels: Clients receive updates through:
- Email: Regular status reports, performance updates, and strategic recommendations.
- Monthly Accountability Reports: Transparent ROI reporting with measurable results.
- Scheduled Check-ins: Strategic review sessions as outlined in your service agreement.
- Project Management Platform: Access to project status, deliverables, and documentation.
2. Service Investment and Engagement Models
Cascade Digital Marketing offers customized service packages based on your business needs and goals:
- Marketing Strategy & Research: Required foundation for all clients. Our proven research system uncovers your customers’ deep motivations using AI-enhanced analysis and synthetic focus groups.
- Ongoing Service Packages: Monthly retainer-based services for website management, SEO, digital advertising, content marketing, and social media management.
- Project-Based Services: Fixed-fee engagements for website design, branding projects, and specific marketing initiatives.
Detailed service inclusions and investment levels are outlined in your custom proposal and service agreement.
3. Fees and Payments
- Initial Strategy Investment: All new clients begin with our Marketing Strategy & Research phase to establish a data-driven foundation. This investment is outlined in your service agreement.
- Retainer Fees: Ongoing services are billed monthly based on your agreed scope of work.
- Project Fees: Project-based work may be billed as a flat fee or in milestone-based installments as specified in your agreement.
- Ad Spend Management: Digital advertising services include separate ad spend budgets paid directly to advertising platforms (Google, Meta, LinkedIn) in addition to our management fees.
- Payment Responsibility: Timely payments are required to maintain uninterrupted service. Late payments may lead to service suspension and additional fees.
4. Prohibited Activities
To protect the quality and integrity of our services, the following activities are strictly prohibited:
- Reselling or Sharing Services: Sharing, reselling, or distributing any services, strategies, or deliverables provided by Cascade Digital Marketing to unauthorized third parties without written consent.
- Unauthorized Use of Work Product: Using research findings, strategic documents, custom algorithms, or other proprietary work product outside the agreed scope or for businesses other than those specified in your agreement.
- Interference with Services: Making significant changes to websites, advertising campaigns, or other managed services without prior consultation with your Cascade Digital Marketing team, which may interfere with performance and agreed-upon strategies.
- Misrepresentation: Falsely representing Cascade Digital Marketing services, results, or relationship with your business.
5. Updates and Communication
- Monthly Accountability Reports: Clients receive transparent monthly reports proving ROI with real business metrics, not just vanity metrics like clicks and impressions.
- Performance Updates: Regular updates on campaign performance, website analytics, content engagement, and progress toward your business goals.
- Strategic Recommendations: Ongoing guidance and optimization recommendations based on data analysis and performance testing.
- Client Responsibility: You must ensure your contact information (email, phone, and account details) remains accurate and up to date to receive important updates and reports.
- Collaboration: Client collaboration is essential for maximum results. This includes timely review and approval of deliverables, providing necessary business information, and maintaining open communication.
6. Suspension or Termination of Services
- Non-Payment: Failure to pay invoices within 15 days of the due date will result in suspension of services until payment is made. Ad campaigns may be paused, and recurring services will be put on hold.
- Policy Violations: Violations of this policy, including unauthorized use of work product or interference with managed services, may result in immediate termination of services without refund.
- Mutual Termination Rights: Either party may terminate ongoing services with 30 days written notice as outlined in your service agreement. Project-based work must be completed or terminated according to the specific project terms.
- Service Continuity: Upon termination, clients will receive final deliverables for completed work, and any service access will be discontinued at the end of the notice period.
7. Ownership and Intellectual Property
- Client Ownership: Upon full payment, clients own the final deliverables created specifically for their business, including website design, content, advertising creative, and published materials.
- Cascade Property: Cascade Digital Marketing retains ownership of:
- Proprietary research methodologies and frameworks
- Custom AI algorithms and tools
- Strategic planning templates and systems
- Any work product created before full payment is received
- Third-Party Licenses: Some services may include third-party software, tools, or platforms with separate licensing terms. Clients are responsible for maintaining necessary licenses for continued use after service termination.
- Portfolio Rights: Cascade Digital Marketing reserves the right to showcase work performed for clients in our portfolio, case studies, and marketing materials unless otherwise specified in writing.
8. Service Management and Changes
- Scope Changes: Changes to the agreed scope of work may require adjustment to fees and timelines. Scope change requests should be submitted in writing for review and approval.
- Service Upgrades: Clients may upgrade or add services at any time. New services will be billed according to current pricing and added to the service agreement via amendment.
- Cancellation of Ongoing Services: Monthly retainer services may be canceled with 30 days written notice. Any setup fees, strategy investments, or project fees are non-refundable.
- Project Pause: For ongoing services, clients may request a temporary service pause. Paused services must be reactivated within 90 days or will be subject to reactivation fees.
9. Results and Performance Expectations
- Our Commitment: Cascade Digital Marketing is committed to delivering measurable results. While we achieve 10X+ ROAS and 50-100% conversion improvements for many clients, specific results depend on multiple factors including industry, competition, budget, and market conditions.
- Data-Driven Optimization: All campaigns and services are continuously tested and optimized based on performance data.
- No Guarantees: While we use proven systems and best practices, we cannot guarantee specific results, rankings, or outcomes. Marketing performance depends on numerous variables, many of which are outside our direct control.
- Transparency: We provide honest, transparent reporting on what’s working and what’s not, with strategic recommendations for improvement.
10. Confidentiality
Both Cascade Digital Marketing and the client agree to maintain confidentiality of proprietary information, business strategies, and sensitive data shared during the engagement. This includes:
- Business strategy and competitive information
- Customer data and marketing insights
- Proprietary tools and methodologies
- Financial information and performance data
